Welcome to Anselly AI. By accessing or using our AI image generation platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these Terms, you may not access the Service.

1. Service Description

Anselly AI provides AI-powered image generation and editing tools, including:

• Text-to-Image: Generate images from text descriptions
• Image Expansion (Uncrop): Extend image boundaries with AI
• AI Photo Editor: Edit, enhance, and modify images
• Background Removal: Automatically remove image backgrounds

2. User Accounts and Registration

2.1 Account Creation

You may use basic features as a guest. To access advanced features, you must create an account by providing accurate and complete information.

2.2 Account Security

You are responsible for:

• Maintaining the confidentiality of your account
• All activities that occur under your account
• Notifying us immediately of any unauthorized access

2.3 Age Requirement

You must be at least 13 years old to use this Service. Users under 18 should have parental consent.

3. Subscription Plans and Billing

Payments are processed securely through Creem. By subscribing:

• You authorize automatic recurring billing
• Subscription renews automatically unless canceled
• Prices are subject to change with 30 days notice
• All sales are final unless otherwise required by law

3.3 Cancellation and Refunds

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No refunds for partial months except as required by law or at our discretion for service issues.

4. Acceptable Use Policy

4.1 Permitted Use

You may use the Service for:

• Personal creative projects
• Commercial purposes (with proper subscription)
• Educational and research purposes
• Professional design work

4.2 Prohibited Use

You must NOT use the Service to:

• Generate illegal, harmful, or offensive content
• Create deepfakes or misleading content without disclosure
• Violate intellectual property rights
• Generate content depicting minors in inappropriate contexts
• Create spam, malware, or phishing content
• Circumvent usage limits or security measures
• Resell or redistribute our services without authorization
• Use automated tools to abuse the service
• Generate content that violates any applicable laws

5. Content Ownership and License

5.1 Your Content

You retain all rights to the images you upload and the prompts you create. You grant us a limited license to process your content solely for providing the Service.

5.2 Generated Images

All images generated by our AI are stored temporarily for service delivery only. We do not use your images for any other purpose. Images are automatically deleted within 1 week after generation.

• Free Users: You receive a non-exclusive license to use generated images. Downloads include watermarks.
• Premium Users: You receive full commercial rights to generated images without watermarks.
• Ultimate Users: Private generation mode ensures your images remain completely private and are never used for any other purpose.

5.3 Commercial Use

Premium and Ultimate subscribers may use generated images for commercial purposes. You are responsible for ensuring your use complies with all applicable laws and third-party rights.

6. Security and Human Verification

We use Cloudflare Turnstile to verify you're human before processing generation requests. This helps prevent abuse and ensures fair service for all users. Failing to complete verification will result in the message "Please Complete Verification."

7. Service Availability and Modifications

We strive to provide reliable service, but:

• The Service is provided "as is" without guarantees of uptime
• We may modify, suspend, or discontinue features at any time
• Scheduled maintenance will be announced when possible
• We are not liable for service interruptions or data loss

8. Intellectual Property Rights

The Service, including its design, code, features, and branding, is owned by Anselly AI and protected by intellectual property laws. You may not copy, modify, or reverse engineer any part of our Service without written permission.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ANSELLY AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICE.

11. Indemnification

You agree to indemnify and hold harmless Anselly AI from any claims, damages, losses, or expenses arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

12. Termination

We may terminate or suspend your account immediately, without prior notice, for:

• Violation of these Terms
• Suspected fraudulent or illegal activity
• Prolonged inactivity (free accounts only)
• At our discretion to protect the Service or other users

Upon termination, your right to use the Service ceases immediately. You may request deletion of your data within 30 days.

13. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with applicable international laws. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration or in the courts of competent jurisdiction.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or prominent notice on the Service. Continued use after changes constitutes acceptance of the new Terms.
